In deference to the social distancing requirements imposed by the COVID-19 pandemic, we have adopted a platform to conduct mediations and arbitrations via Zoom videoconference. Although this medium is less ideal than getting together in person, it nonetheless will permit ADRs to proceed as scheduled in most instances.
Attorneys, adjusters, and parties involved in litigation have faced a level of disruption borne by the uncertainties of the virus and the increasing length of time we will face in moving cases forward. Consequently, being able to interact with one another to seek resolution of pending matters is perhaps more pronounced now than it was even a few short weeks ago.
Litigation, which by its very nature can be stressful on its own, is now made more so by the economic and health concerns many parties now face. These emerging risks are shared by all sides, plaintiff and defendant, insurer and insured.
If we can help reduce stress and anxiety by resolving pending cases now through voluntary or Court ordered ADR, we stand ready to do so through a medium that we believe can be an effective, short-term substitute for in-person sessions. A number of you have mediations scheduled with us in the next 4-6 weeks, and we are prepared to move forward under this platform should everyone choose to do so.
